Legal Question in Credit and Debt Law in Canada

Small Claims Amount

I lent my girlfriend $2500 dollars, and shes now not paying. I have in writing that this money is owe'd to me, but there is no deadline on paper as to when it is to be pay'd back. Can I bring her to court on this? (she has threatened to fight back on the grounds that there is no payback deadline)

Re: Small Claims Amount

In British Columbia if no time for payment is specified, then the time for payment is "on demand"; you should write to her demanding payment by a certain date - say 2 or 3 weeks, and then if she does not pay, you sue her in Small Claims Court.
