Health issue to move home, state to state

While under the influence of alcohol, my brother was arrested and convicted of felony sexual assault child under 15. He has been on probation for 6 months. While in jail, he recieved medical care for a lump on his throat and was told it was not cancer. Recent diagnosis is cancer of the tonsil area and throat. He is to receive radiation and kemo at the same time, pending his dental evaluation. He is working for minimum wage now, we are very concerned he will not be able to continue this and would like to bring him home to Ohio so he can get care, as he is all alone and has no one else to assist with food, shelter and care.

Under proper circumstances, and yours seem to be, your son's probation can be transferred from CO to OH under the Interstate Compact on Probation and Parole.

Advise him to contact his PO and find out the procedure to apply for interstate transfer of supervision to OH.

You need to have him ask his probation officer how to transfer to Ohio. Ultimately it is up to the judge to transfer his case. He may require local counsel to do so.
