Legal Question in Traffic Law in Colorado

113 in a 55 without a license

I was pulled over for going 113 in a 55 mph zone on a motorcycle...upon being pulled over I found that I did not have a motorcycle license. I took a class and thought I was licensed but the officer said I was not. What kind of penalties do I face. Can I lose my regular drivers license? Do I face jail time? What can I do to get charges reduced? Would accepting blame and suggesting community service and a driving class get penalities reduced?

Additionally, the reason I was going at this rate of speed was due to the fact that a Trans Am kept driving carelessly and I wanted to get away from it...ya...maybe I went a little too fast...would suggesting this as a reason for my speeding be a wise idea or would it be better to leave it out? Please help soon my court date is Oct 7th

You are facing a strong likelyhood of jail not to mention loss of your license. See an attorney who specilizes in traffic matters. In N.Eastern Colorado see Jim Forsland; in South Eastern Colorado feel free to contact me.

This is serious, mostly because of the high speed. I think you should consider getting a lawyer. If you want to try to deal with it on your own, go to the court date, try to find out what they will offer you as a plea and what they want as a sentence. Ask if you will lose your license and if there is a chance you will go to jail. The prosecutor should be able to give you this information. DO NOT tell them anything. Ask for a continuance so that you can get a lawyer. They should give you one continuance without any trouble, especially to get a lawyer.

I suggest that you go to DMV and take the motorcycle test - easy and cheap - to get that added to your license. You should find a driving school that is certified by the State of Colorado and take their most extensive course - it will help at sentencing. Finally, you need to learn about how driving a motorcycle at 113 mph can affect those around you - people can die (especially you, but more importantly to the court, anyone you cross paths with) or get seriously injured. Maybe you can speak with people injured in car accidents to learn about your effect on others.

If you want help, contact me.
