Misrepresented property lines

We purchased a new home in Dec 2006, the first on a new street. The property lines had not been pinned but the builder walked the property with us assuring us that it was at least 10 feet behind the propane tank that was bordering our back yard into the woods. We have just received the as-builts and the surveyor has now put a stake in our back yard near the edge of the woods. The propane tank is not even on our property now. We have also planted trees along the back grass/woods line but they are now not on our property either. Do we have any legal rights? Can we make the builder change the property lines so that we now own the grass area in our backyard? The lot behind us is not sold yet. Please advise.

It appears as though the builder made an intentional, a negligent or an innocent misrepresentation. Anyone of these could make him liable. whether he can change the lot line depends on a variety of factors.
