Tree limbs

My neighbor has 2 large trees whose branches overhang my new roof and the power lines leading to my house. Several branches have already fallen on my roof causing gutter and roof damage. I was told that even though the trees were my neighbors that I could cut anything that encrouched on my property. When my contractor arrived today to trim these branches my neighbor went crazy stating that he would sue if I touched the tree limbs. He is an attorney himself. I am concerned because these limbs are a hazard and could easily cause significant damage. My 3 sons bedrooms are located in this area. Can I legally trim back these branches? If so where can I find the law or ordinance that states this? Does it vary from town to town? Thank you for any help you can provide.

If the limbs interfere with the enjoyment of your property, then you can cut the limbs. As far as the specific ordinance, you would have to conduct the research to find it. If you need further help, you can email me at [email protected].
