Legal Question in Real Estate Law in Delaware

Lifetime rights

My husband and I have a legal agreement giving us lifetime rights to the property where we are living. The owner has taken a loan out and now has defaulted on this loan. The bank is starting foreclosure on the property. It is stated in our agreement that we are not liable for any of the owners contracts. What are our rights if we are forced to move out of our house.

Re: Lifetime rights

wen do a lot of property settlements in Delaware. If your "legal agreement" is a life estate to you in deed and you did not sign mortgage agreement, your lifeestate in property should prevail over his foreclosure. The mortgage company needs to be made aware of your life estate asap....Ed Pankowski
