Legal Question in Credit and Debt Law in District of Columbia

What is the law on international consumer debt recovery (US-UK)?

I have been contacted by a debt collection agency in the US (I am in the UK) which is pursing me for an credit card debt.

What are my rights? Can you provide a brief synposis of the law that applies?

Re: What is the law on international consumer debt recovery (US-UK)?

Until the debt collection agency obtains a valid judgment against you for the delinquent debt,

no enforcement actions e.g., garnishments, levies,

liens, forced sales of property, etc., can be pursued against you for the collection of the unpaid debt.

And if you remain in the U.K, it's very unlikely

that anyone pursuing this matter will ever succeed in obtaining such a valid judgment against you.

However, in the event that the collection agency has in fact already obtained a valid judgment against you while you were still in the States,

there are mechanisms recognized in international law which would permit such a judgment to be registered or enrolled(as it's known in some jurisdictions)with the courts of a country like the U.K., and once that was done, enforcement actions could then be pursued there which could include the seizure of any assets which you might have within that jurisdiction.
