Contract Time

On October 20, 2003 I signed �Extra Work Agreement� for some soffet and fascia work from a Company that was doing a roofing job for me. There was no deposit or payment made for this extra work and the roofing job was paid in full. The soffet and fascia work is still not complete. Is there any length of time that the contract is voided if there was not written in the contract?

RESPONSE: Usually if the construction contract does not state when the project will be completed then a "reasonable time" is presumed for completion. In addition, Florida Statute 489.128((1)(h), which concerns disciplinary violations against certified and registered contractors proivdes that "A project may be presumed abandoned after 90 days if the contractor terminates the project without just cause or without proper notification to the owner, including the reason for termination, or fails to perform work without just cause for 90 consecutive days." You may want to just send the contractor a certified letter requesting that he complete within a certain period of time and if not, then to provide a completion date.
