Legal Question in Credit and Debt Law in Florida

Debt i had before I was married

I have a credit card I defaulted on before I got married. I am on disability and have no way to pay. I have a company calling me telling me they are a law firm. They are telling me that they are going to report this on my new husbands credit report and he will be served to go to court. They also said they will garnish his wages. They have nothing but his name and social security number they must have gotten off public records. Can they go after him for this also?

Re: Debt i had before I was married

I would obtain the threats in writing, or at the very least get the name of the person and phone number, and make an apptmt with competent counsel. It seems your husband may have a valid FDCPA claim. The debt is yours not his.
