Legal Question in Credit and Debt Law in Florida

florida SOL for creditors to collect?

Is there a SOL for credit card companies to attempt to collect debt? I heard it was 4 years in Florida. Is there an actual statute in Florida that addresses this?

Thanx

Re: florida SOL for creditors to collect?

This is a very tricky question. Most credit card agreements state the SL is based on a state other than Florida. For exammple, many credit card agreements are from South Dakota which has a SL of 6 years on an open account. You need to read the card agreement. Florida is 4 years if no signed agreement, and 5 years if there is a signed ageement. The SL in the ageement can be waive in some instances. But this is not a topic that can be discussed here. see www.ConsumerLawyerHelp.com for links.
