Knowing my rights
I recently had to file Chapter 13. At the bad advice of my lawyer, my vehicles were not included. 6 months after the bankruptcy was dismissed, I voluntarily gave my cars back to the bank because I lost my job and was behind in payments. Now that the bank has sold the cars and I have a balance due, which I am unable to pay at the present time, I am receiving harassing calls from the collection agency telling me the bank is going to sue me for the balance. I would like to know, can they garnish my wages? I understand that it will take some time for them to take me to court, but the calls are getting to be a bit much. They call me on my work phone, so how do I stop that? What is going to happen if they do sue me?
