Re: Partial Payments

A creditor is not obligated to accept partial payments on a past due debt. A collection agency may or may not have the authorization to accept partial payments depending on what their agreement is with the creditor. Generally though, a creditor and/or collection agency will not mind accepting partial payments. This collector however is giving you a hard time. I would suggest that you put your offer in writing and send the same along with with first partial payment to the collection agency. Send a copy of your letter along with a copy of your check to the Creditor. After this, I seriously doubt that you will be having a further problems.

Feel free to contact me if you should have any further questions.
