Legal Question in Credit and Debt Law in Florida

Statute of Limitations for collecting

I received a collection notice for $311.58. I was stationed in Florida 23 years ago and I do not recall leaving any unpaid bills after my discharge from the military. Is there a statute of limitations for unpaid debts. I would assume after 23 years this debt would be considered uncollectable. The notice I receive stated the account is now legally owned by another company located in Illinois. This is the first ''past due'' notice I received from this company requesting I pay within 30 days.

Re: Statute of Limitations for collecting

So you have not heard from them in over 23... In order to sucessfully pursue such a debt, if valid, they would need to file suit within the statutory limitations set forth by each state. In Texas, the statute of limitations for lawsuits arising out of a contract is 4 years. You can send them a nice letter letting them know that the statute of limitations for this matter has passed and they should cease further communications regarding this debt as to continue may be seen as a violation of the Federal Debt Collection Act and/or the Texas Debt Collection Act.
