Legal Question in Criminal Law in Florida

How long is a prescription good for?

On 04/22/10 I got arrested and charged for possession of paraphernalia. The possession was a straw that contained oxycodone residue. It was so old that I even forgot I had it in my wallet. Now I have been prescribed oxycodone and 06/15/09 was the last time I got my prescription filled. So what I want to no is Do I have a case?

There is no time limit other than what is reasonable to a jury to carry. Most people have old prescriptions so you probably have a defense on that. The straw may be a tougher one though. I suggest you call an attorney and discuss this in person with them.
