Legal Question in Criminal Law in Florida

Merrandia law

At a construction site a man said I hit him with my truck. Five people said they saw it. The man had no marks on his body. The police came and arrested me for aggreative battery with a deadly weapon. They did not read me my rights. Do they have to?

Its Miranda. No, unless they ask you questions while in custody they do not need to read you Miranda. To explore the issue I suggest you make an appt at my office for a consultation.561-317-2910

Re: Merrandia law

They do not have to read you your rights unless they (1) have you in custody, and (2) begin questioning you.

The aggravatd battery sounds fishy. Are you leaving something out, for them to charge you with agg bat, the guy must have said that you intentionally drove your car at his car while he was in it.

Call me if you are in the Orlando area (407) 625-4676.

Best of luck,
