Defemation of Character

We are going to court in regards to

Rent on a home that we were

renting that went into foreclosure,

we moved out on 12/3 when our

lease was until 12/31 we offered to

pay for 12/1-12/3 but the landlord

refused and had filed a claim with

my husbands job with false

alligations in regards to previous

months stating that we were

constantly late on our rent

payments and that we begged her

to come down on the rent because

we could not afford it, also claiming

that we turned away potential

buyers which only happened on one

occasion, when I asked if they could

come a little later in the day. My

question is does this count as

defamation of character?

Defamatory statements are statements that someone makes to others about a person, knowing the statements are false, which cause damage to the person.

I don't know what you mean by the landlord "filed a claim" with your husband's job. Anyway, it seems the landlord made knowingly false statements (assuming what you say is true). What you don't state is any kind of damages.

"Damages" in this case must be quantifiable. Such as, if your husband loses his job as a direct result of the false statements, his damages would be lost income.

If there are damages in this case, you should seek the counsel of an attorney who is experienced in these matters to evaluate your case and advise you of your possible causes of action.
