Legal Question in Family Law in Florida

Myself and my ex have agreed to change our custody agreement. Now the agreement is that he has residental custody of our son but he would like to sugn over custody to me considering he has legal issues at the time and i have had our son since the beginning of the summer of 09 anyway. I was wondering if there was some way we could do this without going through the court system. Can we write up an agreement and sign it and have it notorized with all the stipulations and it still be legal?

If you don't have an order ratifying your agreement, your agreement is not enforceable and he can just come back and take your son at any time.
