Legal Question in Family Law in Florida

I am contemplating divorce in Florida. My husband refuses to work or support the family. I have paid the bills for several years myself. How can I safeguard my money so he doesn't get half? I have a 401K and liquid funds. I have three children to support and a house in joint ownership. Can I prove him a non-supportive spouse so he can't have half?

Money earned during the marriage is clearly marital. If you are frustrated by his refusal to work, then why are you staying with him? Assuming the marriage is over, your best bet is to divorce him sooner than later. If you have been married for at least 7 years, he might be able to try for durational alimony (capped to the length of the marriage). If you have been married for at least 17 years, he might be able to go for permanent alimony.

Unlike some, I will not tell you what you want to hear just to be retained.
