Legal Question in Family Law in Florida

if my daughter father takes her for the night and want give her back to me. Does he have the right too given if he is not on her birth records and has not had a dna test done?

He has no standing to have this child with him. take the birth certificate to the police dept. and go get your child. He could be considered a kidnapper.
