Dependency Court/ State of Florida

If a non custodial father has an active dependency case/case plan

for alleged abuse and neglect, can he legally sue for custody of his other children who are not a part of the dependency case?

A parent with parental rights intact can always petition for custody, but with allegations of abuse and neglect being considered by Dependency court, the non custodial parent would seem unlikely to gain custody.
