I have been married since 9/23/06 I was served with divorce papers on 7/9/2007 What are my rights to assests,(equity from the time we were married) alimony,step-parent child support since I sold my home to move in to his. The money from my home has been used for- from the marriage licence to the garden hose.(he is also treathing to throw-eviction myself and my minor son out on the street). He moved money out of our joint account and open a new account then closed our joint account before he filed. So there was no sign of JOINT assests? Thank you.

Yours doesn't sound like a simple divorce and you have many questions addressing many issues.

1. If the house is in his name, he will get to keep the house. You MAY be compensated for some of the money you put into it during the marriage.

2. You had a very short marriage so unless there are unusual circumstances (if you became disabled during the marriage, for instance), there will be no alimony, at least no permanent alimony.

3. If he took marital money just before filing the petition, the judge may order him to give you your share back in some form or another (other assets?).

4. You may be able to fight his wanting you to leave the house if you have a very young child, for instance. But, that would be a very temporary thing. The house is his and the marriage is getting dissolved.

It doesn't sound as though your dissolution of marriage is going to be friendly. I strongly suggest contacting an attorney for help.
