Legal Question in Family Law in Florida

How do I prove that my son's father is unfit? He has not seen my son is almost 2yrs and has been in and out of jail on drugs chargs and dui. He is very behide on child support. My husband wants to adopted my son but his real father will not sign over rights. What can I do because I do not want the real father back in our lives? I do not have alot of money to get another lawyer.

Believe it or not, you probably don't have enough evidence--based on what you've written--to prove he's unfit. Not seeing a child for two years, even coupled with criminal convictions, is probably not enough to prove a father unfit. Judges are very reluctant to take a child away from a parent. If it had been eight years or so, you'd have a much better chance. Still, you can give it a shot. Some judges are more willing to terminate rights than others. You shouldn't do this without a lawyer, though, since it's a complicated procedure and a child's future is at stake.
