relations during seperation

my husband and I have been seperated for almost 3 1/2 yrs. We had a legal sep. done in the state of Ct. I now live in Fl. For the last few months we have been having marital relations although our seperation agreement says we do not and we are free to be with another. Neither one of us have filed for divorce although we talk about it...by having sex with him, does this mean the seperation agreement is no longer valid?
