Final Paycheck

I changed jobs in late January and my former employer hasn't paid me for the final 11 days that I worked for them. I wasn't under any contract to give notice but I did give 1 weeks notice to insure a smooth tranistion. they have made up stories of why they haven't sent me a check but I want to know what I can do legally to have them pay me. I had to move for my new job so I can't even go by the office to pickup the check (not that they offered) Prev employer: Tampa Florida

in Texas call Texas Workforce Commission for prompt payment...look on internet for comparable agency in Florida..they have the ability to make employers pay...Hiring a lawyer would be difficult as you probably are due less than $2000, right...but look on internet for Florida collection lawyers..if you want to sue..and have proof of what you are owed..good luck

Now don't you feel like an illegal immigrant? I have had so many calls from them since I speak spanish...it is dirty pool..

Depending on a number of things, including your job description and the size of the company, the company may likely in violation of a federal statute called the Fair Labor Standards Act. They may also be in violation of a state labor statute.

If they won't pay, your only recouse may be to file a claim in small claims court. It is a simple process and the forms are available at the court house -- although your absence from Tampa will make the process more difficult and costly for you.
