planned surgery but terminated

Can a company terminate (ch11, reducing work force)someone while medical situation is known and surgery scheduled based on doctor referral and company insurance would be used? Because of termination this person could not proceed with surgery and has serious medical problems. Looks like company will be bought out.

There is not enough information but the company may be violating the right of the individual under the ADA, FMLA and/or COBRA. You may wish to consult with an attorney who specializes in employment law.There is a statute of limitations on these type of cases so be sure not to exceed the statute of limitations
