How long before I can evict a tenant for non payment of rent?

The language in the lease agreement generally determines the amount of time which needs to pass before initiating an eviction proceeding. If the lease agreement is silent as to this matter, then you may serve a proper 3-Day Notice as soon as the tenant fails to pay rent and if the tenant does not deliver possession of the premises or tender payment in full of all past due rent within the time period set forth in the 3-Day Notice then you may immediately commence the eviction proceeding.
