Legal Question in Landlord & Tenant Law in Florida

I am in a terrible situation. I live in an apartment complex and my neighbors are driving me crazy to the point I had to call the police several times, call the leasing agent several times, and wrote two letters to the manangement. The only people who did anything were the police who just simply told the neighbors to quiet down. The leasing agent and the management have not done anything to remedy the situation and the police really can't do nothing about it. There is a security guard but he is there only on the weekends. I am seriously thinking about moving, I've already bought boxes and I'm going to rent a truck tomorrow. I can't not live with this kind of noise. I also went to the neighbors myself to tell them to quiet down, but that didn't work. They are now harassing me and my sister for telling them to quiet down and they had threatened to retaliate against me and my sister for telling management on them. I included that in the letter that I wrote to the management. We've only got 4 months left in our lease and I want to know if I have a right to move out now before something happens. Since management and the leasing office don't care, I feel that I have a justifiable reason to get out of my lease, is the right. Please get back to me as soon as possible.

Thank you

Aruba Roy

It will depend on what your lease states. If your landlord is in violation of the lease -ie not preventing noise and disrutption - if that is what the lease states, then you can sue your landlord in small claims court for the damages (having to move, return of deposit etc). check out your rights on the web under Florida Landlord Tenent Rights.

Wow, I am so sorry about that. Report the nuisance to everyone in writing including the landlord, and check this website for additional information about what your rights as a tenant under Florida law and what you can do in this situation: http://www.800helpfla.com/landlord_text.html
