Legal Question in Medical Malpractice in Florida

medical negligence or personal injury?

I was admitted to a hospital in FL for a simple outpatient polyp removal procedure.After this procedure, I complained of chest pain.I was told that the pain was radiating up from the polyp removal site. I was given two pain shots and stayed in the recovery room for over four hours.At the end of my stay, I was released to travel back home, (10 hours away).By the second day after the procedure, I was still in extreme pain and having trouble breathing. I contacted the coordinating physician. He advised me to go back to the ER.They determined thru X-rays, that the pain in my chest was a result of air that was trapped under my chest area due to a perforation that had occurred from the polyp removal surgery. The ER team performed emergency surgery and I would end up with an ileostomy, depending on the severity of the infection that had set in.My concerns are mistakes were made.I was released to go home(10 hours away),with a perforation in my colon. The surgeon made a mistake by creating a perforation in my lower colon and by discounting the pain and releasing me from the hospital to travel home.

Please let me know your thoughts on if I have a case for medical negligence, malpractice or personal injury.

This does indeed sound like a potential cause of action against the doctor for malpractice. These are difficult cases, but you need a florida lawyer and will have to pursue this case in Florida courts. You need to find a good medical malpractice lawyer in the same area as the operation took place. I'd check the nearest big city.

The best way to find a good malpractice lawyer is not to call on one. Call a lawyer who does something like estate planning or business work or criminal law. They will know to refer the case to someone who is very good in the field and not try to hoodwink you into thinking that they can handle the case. If you call someone who advertises extensively, lord knows what kind lawyer you get (not that all advertising lawyers are bad), but you need to find someone who knows the lawyers in the area and who knows who is good and who is just a blowhard.
