I think you are referring to a wrongful death action. When the death of a person is caused by a wrongful act or negligence, and that victim would have been able to sue and recover damages for those injuries if he had not died, the wrongful death act allows the victim's survivors to bring an action for damages against the person responsible for the wrongful act/ negligence.
