Legal Question in Personal Injury in Florida

My wife and I just divorced on the 31st of Jan. She has had her own apt for 9 months. On March 10 (39 days later) she was involved in a serious accident with a drunk driver. The other drivers insurance is tendering the limit. Question:
1. She was still on our home/auto insurance, which is in good standing, will she be covered?
2. Will I be in violation with 3rd degree felony for not getting her insurance swithced to her?
3. What can i get punished. No record.
4. Is there a grace period to transfer?
5. Do you recommend counsel
