Legal Question in Personal Injury in Florida

I am a single mom and all my 17 year old son asked me for Christmas was a police/fire scanner, he plans to pursue a career as a firefighter/paramedic and is very interested in the police and fire calls. The cost of this scanner is $200.00. I worked overtime and found it on sale at radio shack for $150.00. I really could not afford to get it but I did and its all I bought him. He unwrapped it up this morning and I never saw him so excited. It made my christmas, he then opened the box and his face fell, everthing was in there, the books and software but not the actual scanner. He was so upset, it was his only gift and there was nothing i could do about it until tomorrow. I will go back to radio shack as soon as they open and hope they make this right. but what about christmas, and the emotional stress this caused on my son and I. I spent all my money and never got the gift and my son was so upset he spent the entire day in his room...

No doubt Radio Shack will do the right thing, and get you the scanner that was missing from the package. Since your son is 17 years old, he is old enough to "delay gratification" for a day or two. If he plans on being a firefighter or paramedic, he needs to learn that things don't always turn out for the best, and personal tragedy is always right around the corner. You could have avoided this disappointment by checking the package at the time of your purchase. Lawsuits and courts can not and should not take the "sting" out of a disappointing experience, and your attempt to pursue a legal claim for "emotional stress" sends the wrong message to your son.
