Legal Question in Personal Injury in Florida

Workman''s Comp//Personal Injury

I was a teacher. Taught chemistry/physics in high end private school. they wanted to put in a combined physics/chemistry lab. they ook old english room--put in a chem lab. violated evry OSHA and EPA reg u can think of. Did work including plumbing, electric, and drainage with unlicensed contractor. I told them numerous times this was wrong. Someone was going to get hurt. I was moving equipment along with my dept hear--who also knew it was wrong but like me was told to be quiet. Itrip over faulty stool placement. tore three ligaments in left leg. was witnessed by him.

School did nothing except find reason to get rid of me--i resigned over being fired.

I have active workmans comp case going but would like to go after them for pain/suffering/law violations, etc-- see where I am coming from.

I have insurance license so I know w/c does not pay for pain/suffering but iw any other way to go after these bastards.

Oh--I had been working there with no problems until I let it be known I was filing a w/c lawsuit--then they came up with all kinds of reasons to get rid of me.

Thanks--John

Re: Workman''s Comp//Personal Injury

The employer has comp immunity. Sorry. There are very limited exceptions to this and they are getting fewer and fewer and harder and harder to pursue. Tripping over a stool -- where your own negligence would become a major focus -- would not be a sympathetic case to push, even if you could fall under the exception.
