Eviction Notice or Notice to Vacate?

Hello,

We have a tenant that did not pay for February rent. His lease will end on 2/28/09. If he does not pay us for this month, do we serve an eviction notice or a notice to vacate?

You have a choice. You can serve a 3 day notice for the unpaid rent. A tenant cannot use his deposit for rent normally until after he moves out. Alternatively, you can wait until March 1, and file an unlawful detainer without any further notice based upon the expiration of the lease. Pleaes contact us if you have any other questions.
