I live in Crestview,Florida and my house is now in foreclosure.I have received the first letter from the Wells Fargo attorney. How long from this first letter do i have to leave?

It will be a while, and you have some options. You can consider loan modification and short sale as well as defending the foreclosure action. The bank will need to file a foreclosure lawsuit, and you will be served with the court action. After that time, you will have 20 days to either answer the complaint or file other action which will delay the time for answering. If you hire a lawyer to defend the suit, it can be dragged out for 6-12 months, giving you time to make other arrangements. I strongly urge you to see an attorney to discuss your options.

You shouldn't have to leave right away. Once you receive the court summons and the complaint, you will only have twenty days to respond (file an answer). If you don't file an answer, then the bank can force the sale of your home as soon as two months. If you have only just received a letter to inform you that this attorney may file an action against you, it all depends on when they file. There may be legal options available to you and you may be able to raise defenses to the foreclosure lawsuit. I really couldn't tell you what your options and defenses are until I have spoken to you and reviewed your mortgage or the complaint. The best thing for you to do is to contact an attorney now. Defending yourself against the foreclosure lawsuit can get you at least six more months in your home. Best regards,
