Legal Question in Traffic Law in Florida

When making a right hand turn onto a busy road with 3 lanes going the same way, should you wait for all traffic to clear or just the curb side lane. My feeling is to wait for at least the curb lane and center lane to be clear. Who would be at fault if the curb side lane was clear when you looked and just as you pulled out a driver in the center lane decided to change lanes to the curb side lane because it looked clear to him and so he runs into you as you pull out?

Here's a lawyer answer for you: Do it when it is safe. It is not illegal to turn if you have an open curb lane. That said, you could be held civilly liable if you turn and the other car turns into that lane because they generally have the right of way. If you are involved in this situation I strongly suggest you get an attorney.
