Legal Question in Traffic Law in Florida

speeding ticket

I received a speeding ticket and the police officer wrote the wrong drivers license number on the ticket (wrote a 9 instead of 7 very clearly) and he mispelled my last name. Should I opt for the court date because of these mistakes or just take the driving class and pay?

Re: speeding ticket

Hello:

In response to your question, it probably wouldn't be a winning defense to argue it's not you, because of the typo. mistakes. 'Sorry about that! However, I advise clients to never pay tickets...you automatically get points. As you state you could go to driving school and have the points withheld. You can only go once per year and 5 times in your life. In Duval County and those surrounding Duval, we can set it for a hearing, but when you get there, tell the court you don't want a trial, but rather want to plead no contest and ask for a withhold of adjudication of guilt (which means no points). You can contact your clerk's office and ask if the Court allows that action. You may want an atty. to go for you. Good luck. Tom Rosenblum, Jacksonville
