Legal Question in Wills and Trusts in Florida

New Executor of Estate without a Will

My family have made me the Executor of my fathers Estate. There is no property or cars. Only a small bank account and possibly a Life Insurance policy. What forms do I need since there is no will? If there is a Life Insurance policy, how do I Execute it? I am the sole heir to his estate.

Re: New Executor of Estate without a Will

In Florida when a person dies without a will, Florida statutes control the way in which the estate is divided. If there is no surviving spouse then the assets are divided equally among the children. What forms and/or documents required depend on the size of the estate. With small estates Florida provides for summary administration. You may want to speak with an attorney to determine if your father's estate will qualify for summary administration.
