Legal Question in Workers Comp in Florida
injured at work
Florida-My husband cut his finger at work, severing the tendons and shredding the nerves. He had to have surgery. When it happened, an employee called 911. The manager rushed in and took him to the hospital himself, putting the bill on his credit card. They then told us that they will pay for everything out of pocket. They asked us to say he did it at home. We complied because my husband smokes pot, not at work, on his own time.We thought he would be tested and no bills would be paid. We also both work for the same company and were afraid of losing our jobs. I do not trust these employers and am scared that they will not pay these bills and his lost wages. We regret that we went along with this. What is my recourse? Obviously, I don;t believe that they have worker's comp insurance. It is a Restaurant with more than 15 employees. Also I should add that my husband gets paid partially under the table. I think I need a lawyer, but I don;t know what to do. Please help!!

You are right, see a lawyer who does workers' compensation. This is not a difficult case.

You need to see a lawyer who not only understands workers' compensaiton law but also one who knows how to avoid the exclusive remedy of workers comp in favor of filing a liability suit. If the employer had 15 employees and no workers comp, it is easy to get around workers comp immunity BUT, there may be no other insurance to cover the claim and the restaurant may be judgement proof.
