Legal Question in Personal Injury in Georgia

personal injury-slip and fall

I reside in NJ and was on vacation in Savannah GA in Feb 2008. I slipped and fell at a hotel and injured my knee. The hotel was notifed of the incident and now I have perm nerve damage including paralysis and need to wear a brace on my leg.

I would like to initiate a lawsuit for damages. Would I need to find an attorney in GA or NJ to represent me? Should it be filed in Federal Court, NJ or GA?

I am from NJ orginally and have been in GA since 1973. I have contact with the Wilentz firm in NJ and practice personal injury work in GA.

You have two years from Feb. 2008 to settle your case or file suit. Was it a local hotel or national chain? How did the injury occur and what did the hotel do wrong that caused your injury?

The good news is that the hotel may be subject to jurisdiction in NJ as well as GA. And, typically, a plaintiff will want to file in State Court, and not Federal, but that's a decision your attorneys will make. We handle cases like this all the time. The answer to your question will require some more information. There are significant likelihoods that the case can be handled in NJ, but that will depend on who owns the hotel and their relationship to NJ. On the other hand, if there is no relationship between NJ and the hotel, then you will probably need an attorney in GA.

if this is a National chain, you most likely will have jurisdiction in Federal Court and will not need a GA lawyer

Hello - I am sorry to hear about what happened. If you want to file against the hotel you must file in the jurisdiction in which the hotel "resides". This would mean that you would need a Georgia attorney to file the lawsuit. As far as State or Federal Court that would be a decision made based on several factors.
