Legal Question in Business Law in Georgia

Hi,

I am starting a PC repair service. I came up with a name, registered a domain on the Internet and then found an existing company with the same name. Is it legal to add "PC Services" to the end of my companies name? The existing company is not in the PC services industry but makes and sells electronics.

It is certainly legal in the sense that you can probably incorporate under that name, but the question will remain whether you have the right to use the first part of the name. If not, you may have an infringement problem. But keep in mind there are a lot of variables, e.g. who really owns the rights to the name, whether the name is protectable in the first place, geographic location, and whether they are still doing business under that name.
