Legal Question in Credit and Debt Law in Georgia

Debt Statue Of Limitations

I had a car repossed in 1998 and it remained on my credit for 7 years. I could not get a car or any credit for those 7 years. Now in 2006 I have a collection company calling and writing me about this car. I have told them that I am not working and that I had a child in 2004 and I am at home with him. I went to school in 2005 but I have not been able to find a job in my field because I do not have experience so on top of not being able to find a job I now have these people calling me about a debt that is almost 10 years old. They are rude and pushy what is the statue of limitaions for debt collection in georgia and what rights do I have?

Re: Debt Statue Of Limitations

There is no time limit (or "statute of limitation") on their attempts to collect a debt. The statute of limitations applies to lawsuits, but even then they can file a lawsuit to collect and place the burden on you to raise the defense. You can write them and tell them to not contact you any more, but that sometimes hastens a lawsuit.
