Legal Question in Credit and Debt Law in Georgia

Medical Bill Garnishment

In 1998 I had a hospital bill that was never paid by the insurance company(HMO). The insurance company went out of business the following year. I recieved a letter from a collections agency in 1999 stating the bill was never paid. The insurance company made a payment, but on a later bill it shows an adjustment where the payment was taken back.October 2001 a summary judgment was entered. Long story short the hospital(attorney) garnished my paycheck. I only make $1089 after taxes per month. Is there anything I can do to lower the payments or stop the garnishment.

Re: Medical Bill Garnishment

The amount they can take is limited by law, but we do not know the facts and numbers. Try working out an alternative agreement with the creditor.

Once things get to teh point of a garnishment, that means that you already lost the case, and creditors are unlikely to give up the sure thing and take less.

The one thing that can stop a garnishment besides payment is bankruptcy. Depending on how much you owe, that may be an option for you. If you are in the Atlanta area, go to www.glenashman.com, get a bankruptcy worksheet, and contact my office to review it.
