Forgery?

My fiancee pawned the title to his car about a year ago. The title was in his fathers name who actually has the exact same name as my fiancee. His father gave him the title knowing that the entire purpose of him wanting the title was to pawn it. During the paper work my fiancee signed his OWN name (which like I said they have the same name) here recently him and his father got into an arguement, and now his father wants to charge him with forgery, being that he signed his own name, is that possible? If so, what kind of a defense can he use to fight it? Please get back to me on this.

It's not forgery if his father authorized him to sign the title. But are you sure your fiancee is telling you the truth? Kind of curious why he would sell it to a pawn broker rather than in the usual matter. As though he was trying to unload it in a hurry. And it is not very fatherlike to get that angry at his son, although rifts like that do occur. If actually charged with forgery, a key part of his defense will have to be his father authorized him to sign the title and receive the money. The mere fact they have the same name does not itself authorize each of them to sign off for the other.
