Legal Question in Criminal Law in Georgia
Public defender representing two ppl independently for the same case
My brother was charged with Armed robbery in Geaorgia, his girlfriend drove 'the getaway car'. She was initially charged with accessory. They had the same public defender representing them indepently. My brother did not show a weapon, he said he had one to the clerk of a service station. The clerk herself said she did not feel in danger for her life. He did not understand that Ga had a mandatory 10 yr sentence w/o parole for armed robbery and that was never stressed to him~ they would have charged him with theft by intimidation if he would say that she was involved. He didn't and was given 10 yrs~ his girlfriend got off w/probation. Can the same lawyer represent two people for the same crime and get two radically different outcomes and have represented both of their best intrests?

Re: Public defender representing two ppl independently for the same case
It is possible for an attorney to represent 2 defendants on the same crime as long as there is not a conflict of interest and the judge, clients and prosecuting attorney all consent to it. Your situation does seem to prent a problem and the girfriend should have had a different atty.
