How long before I can throw away ex's belongings?

My ex girlfriend and I own two properties together. We have broken up and she

has moved to the other property and has been there for approx. 3 months. I

have asked her on numerous occassions to get her belongings, but she says she

is not ready yet, etc. Things are getting tense as more time goes on, and I

finally told her this past Tuesday, that she had until Friday to get her things or I

would throw them in the garbage as Friday is trash day. She told me she would

come tonight, Thursday, to get them and it is 9pm and I have heard nothing.

Can I legally toss her things tomorrow?

I would not advise you to throw them away. Put them in a cheap storage unit. Then, consult with a local attorney about a Petition to Partition. You can include the cost of the storage in your claim.
