Legal Question in Family Law in Georgia

rights after a divorce for debts incurred while married

Even though the divorce decree said I was no longer liable for the debts in my name while married, I have found that is not true. If my x-husband goes bankrupt, am I liable and to what extent?

Generally, if your ex-husband files for bankrupcty, the creditor may still have the right to collect its debt from you - notwithstanding the provisions in your divorce decree. Even if your ex-husband does not file for bankrupcty protection, the creditor, if filing a lawsuit, may be entitled to include you as a defendant for collection.
