Legal Question in Family Law in Georgia

temporary child custody laws

we were ordered temporary full custody of my husband's son on August 8, 2003. His ex wife said that her lawyer told her that a temporary order is only good for 6 months. So now she is saying that she isn't going to let him come home this weekend after his visit with her. During the temporary hearing there was no mention of a limit on the temporary order. After the hearing my husband asked his lawyer how long the order could stay temporary and she said if the ex wife doesn't takes us back to court for a full hearing to try to get custody back it could stay temporary from now on.

Re: temporary child custody laws

Your husband's attorney is correct. Unless a temporary order contains an expiration date, it stays in effect until and unless modified by further order of the court.
