Joint Motion to reopen denied. DHS attorney will not join in the motion to reopen. Can this be appealed? If so to who, IJ or BIA of do I need to do a new joint Motion to reopen?

refile the Joint motion (should be adjudicated by a different attorney).; If denied you dont appeal joint motions - make sure you have lots of supporting documents to bolster argument. You are not numerically barred on filing joint motions; but cannot be frivolous. You could also try filing Sua Sponte.
