Legal Question in Immigration Law in Georgia

want to marry high school sweetheart

Hi, I am on H-1b which I got after changing from F1. Due to economic period and long delays, I do not want to travel back to my country (I am from Pakistan and you know that it is even stricter for Pakistanis). I want to marry my High School love. Can I bring her here on B1/B2, marry her and then send her back to get an H4? Or should I ask her to come in as F1, marry her and then change her status after 2-3 years to H4 (I do intent to send her to school over here).

Re: want to marry high school sweetheart

Dear Inquirer:

You cannot bring your fiancee here on a B-2 visa to marry her. Even if this were possible, she would only be admitted for up to 6 months, so she could not legally wait "3 or 4 years" to change her status to H-4.

I recommend that you email me at [email protected] or visit www.hanlonlawgroup.com if you would like to schedule a consultation to discuss this matter further.

You can marry her in Pakistan, where immediately after marriage she can apply for H-4 visa (and you get H-1B visa stamped in your passport), and you both can travel back to USA. It seems to be a reasonably good plan.

All other plans seem to require more effort on her part to procure a visa to USA. Whether your fiancee will be able to get a B2 or F1 visa is not clear. Otherwise, it could be possible to marry in USA and apply to change status to H-4 while she is in USA.
