age discrimination?

For 2 years I have been employed by the same retail store. During this time I have been turned down three times for a promotion to assistant manager. The only reason I have been given is my age. First, I was told the age limit was 20(I was 19), now it is 21(I am now 20). In each case, my experience and job performance exceeded those of the new hires, and all have been detremental to the store. Is it legal for the company to deny a promotion on the sole basis of age?

In this case, it probably is legal, assuming they are not violating their own policies. The Federal Age Discrimination in Employment Act only protects those individuals aged 40 and above. Since Georgia does not have any laws giving additional protection to those under 40, there are no laws protecting people under the age of 40 from age discrimination.
